G.O.RT.No.11, Dt:20.1.15 :: constitution of “Internal Complaints Committees” (ICC) to receive complaints on sexual Harassment of Women at work place

G.O.RT.No. 11 WCD & SC Department, Dated: 20-01-2015 :: Public Services – Department for Women, Children, Disabled & Senior Citizens – Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 – Constitution of a Committee i.e. “Internal Complaints Committee” in Department for Women, Children, Disabled & Senior Citizens – Orders – Issued.

Read the following:-
1. Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

ORDER:-
1. In the reference read above, the Ministry of Women and Child Development, Government of India, New Delhi while enclosing the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 has stated that, it is mandatory to constitute “Internal Complaints Committees” (ICC) as per Section 4 (1) of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

2. After careful examination of the matter, as per Sub-section (2) of Section (4) of the act, Government hereby constitute a “Internal Complaints Committees” (ICC) to receive complaints on sexual Harassment of Women in WCD & SC Department with the following members.

3. The presiding officer and every member of the Internal Complaints Committee shall hold officer for such a period, not exceeding three years, from the date of their nomination as may be specified by the employer.

4. The member appointed from amongst non governmental organizations or associations shall be paid such fees or allowances for holding the proceedings of the Internal Complaints Committee, by the employer, as prescribed in Rule 3 of the Act. The employer shall be responsible for the payment of allowances referred to in sub- rule(1).

5. The Presiding Officer or any Member of the Internal Committee shall be removed from the committee when:
(a) contravenes the provisions of section 16; or
(b) has been convicted for an offence or an inquiry into an offence under any law for the time being in force is pending against him; or
(c) has been found guilty in any disciplinary proceedings or a disciplinary proceeding is pending against him; or
(d) has so abused his position as to render his continuance in office prejudicial to the public interest.
The vacancy so created or any casual vacancy shall be filled by fresh nomination in accordance with the provisions of this section.

6. The Internal Complaints Committee shall act as per the provisions of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) act, 2013 and Rules.
